SMS Terms and Conditions and Privacy Policy

SMS TERMS AND CONDITIONS

1. Introduction

These SMS Terms and Conditions ("Terms") govern the text messaging program offered by S V Enterprises Incorporated Micro-Tech USA ("Micro-Tech USA," "we," "us," or "our"). By providing your mobile number and opting in to receive text messages from Micro-Tech USA, you agree to these Terms.

2. Program Description

Micro-Tech USA is a managed service provider. Our SMS program provides clients and their authorized contacts with MSP-related operational communications, which may include outage and service disruption announcements, scheduled maintenance notices, appointment or support-ticket updates, security or service alerts, status updates, and other messages related to the IT services we provide.

Message frequency varies. You may receive up to 4 messages per month on average, with occasional bursts of up to 20 messages in a month during outages, security events, scheduled maintenance, active support matters, or other time-sensitive service conditions.

Consent to receive SMS messages is not a condition of purchasing goods or services. Standard message and data rates may apply according to your mobile carrier and service plan.

3. Opt-In and Consent

You may opt in through a written or electronic consent form, a service or support onboarding process, an SMS keyword, a phone or IVR confirmation, or another method that clearly records your consent. You must be the subscriber or customary user of the mobile number provided and have authority to consent to messages at that number.

Your consent applies only to messages from Micro-Tech USA concerning the purposes described when you opted in. We retain records of consent as reasonably necessary to operate the program and comply with applicable requirements.

4. Opting Out

You may opt out at any time by replying STOP to any Micro-Tech USA text message. We may send one final message confirming that your opt-out request has been processed. After that confirmation, we will not send further SMS messages unless you later provide new consent. Other recognized opt-out requests will be honored as required by applicable law and carrier rules.

5. Support and Help

6. Delivery and Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to network availability, carrier processing, device compatibility, and other conditions outside Micro-Tech USA's control. Micro-Tech USA does not guarantee that every message will be delivered or received within a particular time.

7. Acceptable Use and Security

SMS is not guaranteed to be secure. Do not send passwords, payment-card information, Social Security numbers, protected health information, or other highly sensitive information by text. For urgent IT support or emergencies, use your established support or escalation channels in addition to SMS.

8. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on our website with a revised effective date. Continued participation in the SMS program after an update constitutes acceptance of the revised Terms to the extent permitted by law.

SMS Privacy Policy

1. Introduction

Micro-Tech USA is committed to protecting your privacy. This SMS Privacy Policy explains how we collect, use, disclose, retain, and protect information associated with our SMS program.

2. Information We Collect

When you enroll in or interact with our SMS program, we may collect your mobile telephone number; your name, company, role, or account association; the date, time, source, and method of your consent; message content and delivery information; and interaction data such as HELP, STOP, and other replies.

We may also associate SMS communications with a support ticket, service event, maintenance activity, or client account when reasonably necessary to provide MSP services.

3. How We Use Information

We use SMS-related information to send operational and service communications; provide support and respond to requests; manage consent, preferences, and opt-out requests; maintain records of messaging activity; protect our systems and clients; troubleshoot delivery issues; and comply with legal, regulatory, carrier, and messaging-platform requirements.

4. Data Sharing

We do not sell SMS program personal information. We do not share or transfer mobile numbers, SMS opt-in data, or SMS consent with third parties or affiliates for their own marketing or promotional purposes.

We may disclose limited SMS-related information to vendors and service providers that help us operate the program, such as telecommunications carriers, messaging platforms, hosting providers, and IT service providers. Those parties may use the information only to provide services to us or as required by law. We may also disclose information when required by law, to protect rights or safety, or in connection with a business transaction subject to appropriate confidentiality and legal safeguards.

5. Data Security and Retention

We use reasonable administrative, technical, and physical safeguards designed to protect SMS-related information. No transmission or storage system is completely secure, and SMS messages may be accessible to mobile carriers, messaging providers, device users, or others with access to the recipient's device or account.

We retain SMS-related information only for as long as reasonably necessary for the purposes described in this policy, including providing services, documenting consent and opt-out requests, resolving disputes, and meeting legal or contractual obligations.

6. Your Choices and Requests

You may opt out of SMS messages at any time by replying STOP. Reply HELP for assistance. To request access to, correction of, or deletion of SMS-related personal information, email service@mtusa.com or call (312) 357-0023. We will evaluate requests in accordance with applicable law and may need to verify your identity.

7. Children's Privacy

Our SMS program is intended for business clients and their authorized contacts and is not directed to children under 13. We do not knowingly collect personal information from children under 13 through the SMS program.

8. Updates to This Policy

We may update this SMS Privacy Policy from time to time. The latest version will be posted on our website with the effective date shown above.
